(hereinafter referred to as: Broadstreet), with registered office at Herengracht 500, 1017 CB Amsterdam, are responsible for the processing of personal data. This is explained in this privacy statement.

  1. Personal data that we process

Broadstreet processes your personal data when you use our services and/or when you provide us with this data to us to enable us to supply your required services to the best possible level. You provide us with this data by e-mail, post, or telephone, or personally hand it to us.

An overview of the personal data that we process is presented below:

If you are a private client:

By ‘private client’ we mean someone who uses our service concerning tax matters. This includes the preparation of income tax returns, or a request to the Dutch Tax and Customs Administration (the ‘DTCA’) for a deferment of payment or for a payment schedule that does not include any declaration of profit by a business owner or work performed by us for businesses or business owners. As well as any advice on tax related matters.

Standard personal data concerning you and/or your partner

  • First name and surname
  • Gender
  • Address
  • Date of birth
  • Telephone number
  • E-mail address
  • Other personal data that you actively supply, for example, by uploading documents in our client portal, or by telephone or written correspondence

Special and/or sensitive personal data that we process concerning you and/or your partner and/or your children who live with you

Broadstreet processes the following data only insofar as necessary for us to provide our service:

  • Citizen service number (Burgerservicenummer, ‘BSN’)
  • Marital status: married, registered partnership, divorce/separation, and date of any change in marital status
  • Details of divorce such as divorce settlement and agreed terms concerning children such as joint custody
  • Details of your household: cohabitation contract, members of household
  • First and surnames of your children, living at home or otherwise
  • Your children’s dates of birth
  • Your children’s citizen service numbers (‘BSN’)
  • Details of children’s day-care
  • Financial data, such as annual statements from employers and/or benefit agencies, details of your own home, etc.
  • Financial details pertaining to assets and/or liabilities
  • Tax data: copies of tax assessments and/or filed tax declarations not more than five years old

If you are a business client:

By ‘business client’ we mean someone who uses our services concerning bookkeeping, payroll and other administrative tasks, and tax matters such as preparing your profit tax returns for income from business and/or corporation tax returns relating to the association, foundation, or limited company that you manage or of which you are a director-majority shareholder. Or someone for whom we apply for a deferment for filing your income tax and/or corporation tax return. As well as any advice on tax related matters.

  • Date of formation of business
  • Other personal data that you actively provide to us, for example, by uploading documents in our client portal, or by telephone or written correspondence

Special and/or sensitive personal data that we process concerning you and/or your partner and/or your children who live with you and your business(es)

Broadstreet processes the following data only insofar as necessary for us to provide our service:

  • Citizen service number (‘BSN’)

  1. Purpose and basis of the processing

Broadstreet processes your personal data for the following purposes:

Purposes for processing data for a private client:

  • To supply the following services:
    • Income tax return (not more than five years old)
    • Inheritance tax return
    • Gift tax return
    • Request to the DTCA to receive and make changes to Allowances, including the Child-related Allowance, the Health-care Allowance, Rent Allowance, and Child Day-care Allowance
    • Request to DTCA for payment schedule
    • Request to DTCA for payment deferment
    • Request to DTCA for deferment in filing tax return
    • Request to DTCA for digital copies of assessments (SBA)
    • Request to DTCA for the use of data provided and filled in by the DTCA in advance
    • Request to DTCA for data concerning allowances
    • Request to DTCA for the application of the 30% regulation
  • To send invoices and settle your payments;
  • To send our newsletter by e-mail, for which we use only your name and e-mail address;
  • If there is a statutory basis for this, e.g.: your consent, a contract, or statutory obligation;
  • To be able to contact you by telephone or e-mail if this is necessary to be able to supply our service;
  • To inform you about changes to our services and products;
  • To create an account for you in our client portal.

Purposes for processing data for a business client:

  • To supply the following services:
    • Income from business (profits) tax returns (no more than five years old)
    • Request to the DTCA to receive and make changes to Allowances, including the Child-related Allowance, the Health-care Allowance, Rent Allowance, and Child Day-care Allowance
    • Request to DTCA for payment schedule
    • Request to DTCA for payment deferment
    • Turnover tax return, per month, quarter, or year
    • Wage tax/social insurance liability returns per month or per quarter
    • Return pertaining to pension fund to which your business is affiliated
    • Corporate income tax return
    • Dividend tax return
    • Processing of your business administration/accounts for tax purposes
    • Processing of your business administration/accounts for your own needs
    • Processing of your payroll administration
    • Request to DTCA for deferment in filing tax return
    • Request to DTCA for digital copies of assessments
    • Request to DTCA for the use of data provided and filled in by the DTCA in advance
    • Request to DTCA for data concerning allowances
    • Request to DTCA for the application of the 30% regulation;
  • To send invoices and settle your payments;
  • To send our newsletter by e-mail, for which we use only your name and e-mail address;
  • If there is a statutory basis for this, e.g.: your consent, a contract, or statutory obligation;
  • To be able to contact you by telephone or e-mail if this is necessary to be able to supply our service;
  • To inform you about changes to our services and products;
  • To offer you the option of creating an account.

The processing of personal data is necessary for performing our contract with you. In addition we also process personal data for which you give your consent. If you are not able or willing to provide us with all required data then we will not be able to supply our service effectively. In most such cases we will not be able to assist you further.

  1. Decisions based on automated processing

Broadstreet does not take any decision based on automated processing on matters that could have significant consequences for individual persons. Such decisions are those taken by computer programs or systems without any intervention by any human (such as an employee of Broadstreet).

  1. Retention periods

Broadstreet does not keep your personal data for longer than is strictly necessary to achieve the goals for which it is collated, except where there is any statutory obligation to keep it for a longer period.

Given that our service is virtually always in relation to government bodies (such as the Dutch Tax and Customs Administration), data is retained for a period of seven years as required by law.

Data that you provide to us on paper will be digitized by making a scan of this data and then storing it in digital form.

The original paper documents will be returned to you by post at such time as that we no longer require them. If this is not possible, or you do not require their return, the original papers and copies thereof will be destroyed by De Graaf Groep BV. De Graaf Groep BV will then certify that the paper documents have been destroyed.

Data in paper form that we do not or cannot digitize will be returned to you at the end of the retention period. Should this step not be successful, this paper will also be sent to De Graaf Groep BV to be destroyed.

  1. Sharing your personal data with third parties

Broadstreet will not sell your data to any third party and will only forward it to a third party if this is necessary for the performance of our contract with you or to comply with any statutory obligation.

Tax returns will not be filed until you have given your consent to this orally or in writing (by e-mail or by post).

We will not supply your data to other institutions and officials such as banks, lawyers/attorneys, receivers, financial intermediaries, business administration firms, or accountants, etc., without your express request, and only once we have received your written consent.

We enter into data processor contracts with organizations that we engage to process your data to ensure that they process your data with the same level of security and confidentiality. These organizations are termed ‘sub-processors’. Broadstreet remains liable for the processing carried out by these third parties.

So that Broadstreet can provide an accurate and effective service, we engage the following sub-processors:

  • Nextens: software for drawing up income tax and corporate income tax returns
  • Exact online: software for book-keeping, business administration, and payroll administration
  • Simplicate: software for CRM, HRM, Project Management, and Invoicing
  • Iuro: data manager
  • CreAim: online client portal (My Broadstreet)
  • Cloud services for the digital storage of personal data
  1. Cookies or comparable technology

Broadstreet uses technical and functional cookies. Broadstreet also uses analytical cookies on the basis that these do not infringe your privacy. A cookie is a small data file that is stored on your computer, tablet, or smartphone on your first visit to this website. The cookies that we use are necessary for the technical functioning of this website and for your ease of use. They ensure that the website works correctly and remembers your preference settings, for example. They also help us to optimize our website.

You can refuse cookies by setting your internet browser in such a way that it no longer stores cookies. You can also delete all information previously stored via your browser settings.

  1. Security

Broadstreet takes the security of your data seriously and has adopted appropriate measures to combat the misuse, loss, or unauthorized disclosure of, or unauthorized access or unauthorized change to, this data. If you feel that your data is not properly secured or there are indications of misuse, then please contact our office.   1. Rights of data subjects

You have the right to access, rectify, or erase your personal data at any time. Some of this you can do yourself via your personal account settings at https://my.broadstreet.nl/. Otherwise you can do this by sending us a request.

You can cancel your subscription to our newsletter by clicking on the unsubscribe box in the newsletter. You have the right to withdraw any consent for data processing or to object to the processing of your personal data by Broadstreet You also have the right to data portability, which means that you can ask us to forward any of your personal data that we store in a digital file to yourself or to any organization specified by you.

You can send any request for access to, or rectification, erasure, or transfer of, your personal data, or withdraw your consent to, or your objection to, the processing of your personal data, to info@broadstreet.nl. To verify that it is you requesting the access, we ask that you send us a copy of your ID document together with your request for access. In order to protect your privacy, you should black out in this copy document: your photo, the MRZ (machine readable zone, the bar code and numbers at the bottom of the passport page), your passport number, and (if included) your citizen service number (BSN). We will respond as quickly as possible to your request, and in any event within four weeks.

Broadstreet would also advise you of your right to file a complaint with the Dutch Data Protection Agency if your personal data has been unlawfully processed.
